1. Regulations for testing
1.1. After logging into Proctoring System using an internal account or a partner's platform account, you (the User) will receive access to the list of available tests/exams where you may select an available exam or perform other actions according to your Institution’s regulations.
1.2. After choosing the test/exam, you will be taken through the identification process according to the instructions of the system and the Proctor.
1.3. After successful identification, Proctoring System will give you access to the test/exam.
1.4. During the test/exam, Proctoring System will record all your actions, the desktop of PC/device and transfer these recordings to your Institution for subsequent review.
2. User requirements
2.1. The User agrees not to pass the access details of their account to third parties.
2.2. The User must provide all the conditions required by Proctoring System:
- adequate lighting
- a low noise environment
- a document identifying the User
- no interference in the transmission of the video and audio signal
- fulfillment of technical requirements for the User’s equipment (see below)
2.3. The User agrees that the person whose ID and image were stored in Proctoring System after the first login is the owner of the account in Proctoring System.
2.4. The User must use their original ID for identification.
2.5. The User must not leave the observed zone of their webcam during the test.
2.6. The User must keep the microphone switched-on during the test/exam.
2.7. During the test/exam, the User agrees to use only one display device (a monitor, a TV, a projector), one keyboard, one pointing device (a computer mouse, TrackPoint, etc.)
2.8. The User is not allowed to resort to third party assistance during the test/exam.
2.9. The User is not allowed to provide access to their computer to third parties during the test/exam.
2.10. The User is not allowed to participate in conversations with third parties, to use reference materials (books, cheat sheets, audio recordings), cell phones, pagers, calculators, tablets and computers, except the one that is used directly during the test.
2.11. The User agrees that the Proctor has the right to terminate the testing process in the event of breaking these Rules or violations of ethical standards by the User.
3. Requirements for the User’s equipment
3.1. ОS Windows 8, 8.1, 10, 11, Mac OS 10.9 and higher
3.2. Google Chrome web browser (latest version)
3.3. Working and switched-on webcam (including built-in cameras in laptops)
3.4. Working and switched-on microphone (including built-in microphones in laptops)
3.5. Stable internet connection with data rates of not less than 1 Mbps
3.6. The ability to transfer video using WebRTC protocol.
4. Processing of identity data and recordings
4.1. Your Institution has engaged Constructor Technology to provide remote proctoring services in connection with your exam. Depending on the configuration selected by your Institution, this may include:
- monitoring your presence and behaviour during the exam session through video and audio recording; and
- identity verification at the start of the session, including comparison of your image with a photo identification document you present.
Identity verification is an optional feature that your Institution may enable at its discretion. Constructor Technology provides the technical functionality for this feature, but your Institution determines whether and how it is used. Where enabled, identity verification may involve the processing of facial images or other features relating to your physical characteristics. Your image may be compared against identification data or reference images provided or controlled by your Institution, including databases under its authority. The purpose of this processing is limited to assisting your Institution in confirming that you are the individual registered for the exam. Monitoring of presence and behaviour during the exam is carried out in accordance with parameters defined by your Institution. Your Institution determines which proctoring features are used and remains responsible for deciding whether exam requirements have been met.
4.2. Your Institution determines:
- which proctoring features (including identity verification) are enabled;
- the applicable legal basis for processing;
- how exam recordings and any alerts are evaluated; and
- any academic or disciplinary consequences.
Constructor Technology does not determine exam outcomes and does not define the policies governing exam administration.
4.3. When you access a proctored exam session, Constructor Technology software will request permission to use your device’s camera and microphone in order to enable the proctoring functionality selected by your Institution. If enabled by your Institution, this may include:
- capturing your image at the start of the session for identity verification;
- recording audio and video during the exam session; and
- capturing limited screen activity during the exam session.
Where identity verification is enabled by your Institution, your facial image may be compared against a reference image or identification data provided or controlled by your Institution. Constructor Technology does not independently source or create reference databases for this purpose.
During the exam session, automated tools, including artificial intelligence–based systems, may be used to analyse audio, video, and screen data against parameters defined by your Institution. These tools may generate alerts or flags where certain predefined patterns or behaviours are detected. Such alerts are indicative only and do not constitute a final determination. All assessments regarding exam integrity and compliance with exam rules are made by your Institution.
Constructor Technology provides the technical infrastructure for these functionalities and processes the data on behalf of your Institution in accordance with its documented instructions.
4.4. All captured images, recordings, related technical logs, and any system-generated alerts are made available to your Institution. Constructor Technology does not determine whether any behaviour constitutes a violation of exam rules and does not decide exam outcomes. Your Institution remains solely responsible for reviewing the materials and determining whether exam requirements have been met.
4.5. Separate from the exam-specific processing carried out on behalf of your Institution, Constructor Technology may process certain data for the limited purposes of maintaining, securing, and improving its proctoring services, where and to the extent permitted under the data processing agreement concluded with your Institution. The scope of such processing, including whether personal data may be used for service improvement, is defined contractually between Constructor Technology and your Institution. Where feasible, such processing is carried out using anonymised, aggregated, or otherwise de-identified data. Where personal data is used for these purposes, it is processed under a distinct legal basis as described in our Privacy Notice and subject to appropriate safeguards and access controls.
4.6. Constructor Technology retains exam-related photos, recordings, and associated technical data for a defined retention period as agreed with your Institution in the applicable data processing agreement. Unless otherwise specified in that agreement or required by applicable law, this period will not exceed 30 days following your last interaction with the Constructor Technology software in connection with your Institution. After the applicable retention period expires, the data is securely deleted or anonymised. Your Institution may retain copies of recordings or related materials for a longer period in accordance with its own policies.
